The following is the process to deal with a home as part of an estate sale


1. Determine Ownership & Authority to Sell
Check how the home was titled:
Joint tenancy with right of survivorship: The surviving owner automatically takes full ownership.
Sole ownership or tenants in common: The home becomes part of the deceased’s estate.
If the estate goes through probate, the personal representative (executor) must be appointed by the court and granted authority to sell.
If you’re unsure of the ownership status or probate requirements, consult an estate attorney. Mike Juliff cannot offer legal advice but can coordinate with your attorney as needed.
2. Obtain Letters Testamentary or Letters of Administration
These are court documents that authorize the personal representative to act on behalf of the estate.
This step is required before listing the home if probate is involved.
3. Secure and Maintain the Property
Mike can advise on securing the home, managing utilities, and arranging for cleaning or maintenance.
If necessary, he can recommend trusted vendors for estate clean-outs or repairs.


4. Prepare the Home for Sale
Conduct a market analysis to price the home accurately.
Recommend cost-effective improvements.
Arrange for professional photography and listing prep.
5. List and Market the Property
Once legal authority is in place, Mike will list the home, handle showings, and communicate with buyers on your behalf.
6. Accept Offer and Close
Once an offer is accepted: The personal representative signs the purchase agreement.
Mike sends documents to the title company
If probate court approval is needed, this must be obtained before closing.
